摘要:	本人從事地政士工作多年，有感於2025年超高齡社會即將來臨，少子化嚴重，能得善終，除身心機能外，也需要法律協助與財務支持。臺灣的長輩與家庭，自有不動產比率高，生前「財產」可自由規劃，安心養老！死後「遺產」也可超前部署，避免活人爭產！從客戶的需求，看到自身工作的意義。本論文研究目的，在於提供資產傳承多元方案的選擇與適用，積極協助客戶風險識別、溝通，解決問題。其研究方法採文獻回顧分析、焦點訪談實證調查、個案研究法，忠實記錄研究過程。法律風險管理，強調預防勝於治療，認知、管控、分散法律風險。本論文基於私法自治，以當事人意思自主為中心，以不動產資產傳承為主要研究範圍，建構生前借名登記與贈與後再信託模式、死後繼承模式、生死之間意定監護契約模式、超高齡金融規劃資產傳承創新模式多重安全網，從身份到契約，客製化樂活善生最適行動方案，並附錄法務部成年人意定監護契約書範本，供各界參考。 I have been working as Landsman for many years, I know that clearly and deeply that the super-aged society is coming in 2025. Low birth rate became a serious issue. To be able to passed away in a natural death. In addition to physical and mental functions, we also need legal law assistance and financial support.The Taiwanese elders and families, has higher rate of their own real estate, during one’s lifetime the “property” can plan with their own will, be at ease after retirement.After death the “heritage” can also be done in advance deployment. To avoid any others fighting over the legacy.From the client’s requirements, understanding the worth of my own’s task. The research purpose of this thesis, is to provide estate planning for suitable options with multiple programs, actively assist customers in risk identification, communication, and solving problems. The method of this research adopted the literature review, focus interview in empirical investigation, individual case study. Well-written with both illustrations and description. Recorded the process of the research with pure honesty.Legal risk management, is emphasis on prevention over the cure. Cognitive, control and diversity legal risk.This thesis is based on self-rule of private law. Centered on the autonomy of the parties. Inheritance with real estate assets as the main research area. To build before death “borrow other’s names for registration” and “gift” after the trust pattern. After deceased inherit pattern, between life and death voluntary custody contract. Super-aged financial planning. Estate planning for “estate” as an inheritance tool. The innovation method multiple security protection. From identity to contract. Customized the advance total planning with optimal solution action plan with appendix of Legal Department. Adult consent of guardianship template contract, Offering reference to everyone else.
