    Abstract: 隨著數位時代的來臨,網路直播成為最受歡迎的新興產業,並且迅速發展,直播平台如雨後春筍般出現,時下年輕人亦紛紛投身於網路直播行業中。儘管網紅經濟及直播產業持續成長,然而直播產業具有發展快速與即時的特性,其複雜的程度亦衍生諸多的法律風險問題。直播產業中所涉及的法問題,包括不當直播內容,可能侵害著作權也可能涉及色情猥褻等。因此,應釐清直播平台的法律義務與責任等問題,且促進平台發展自律規則使平台能呈現適當的內容。此外,直播主亦應承擔其責任義務,並遵守自律行為規範,同時認識法律權利與責任,藉此才能使產業內法律問題得以減少並有效的控制。本研究從直播內容可能涉及之法律風險進行探討,再透過訪談行業內直播主來認識目前所面臨的實務議題,以直播主視角面臨之法律風險問題來進行研究分析,並找尋法律風險之解決辦法。本研究認為,直播因其產業特性,若僅依法律進行約束,其適用性及是否能加以明確規範之程度仍有待探討,且亦應促進平台與直播主等遵守自律規範以約束自身行為及平台內容的呈現,藉此達到「他律」與「自律」之公私協力動態平衡,使直播產業走向更穩健、正向之發展。
    In the digital era, the online streaming has become the most popular emerging industry, and it is developing rapidly. Live-Streaming platforms have sprung up like mushrooms after a rain, and young people are also gradually joining the online broadcasting industry. Although the Internet celebrity economy and the live-streaming industry continue to grow, the live broadcast industry has the characteristics of rapid development, and its complexity also brings in many legal risks. The legal issues in the live-streaming industry include the inappropriate content, copyright infringement, pornography, etc. It is necessary to know the online platform’s obligations and responsibilities so that the platforms would develop self-regulation for keeping appropriate content. In addition, the streamer should be held accountable for their inappropriate content online. They need to improve their self-discipline and know more about their legal rights and responsibilities. This research focuses on the legal risks in live-streaming industry. Interviews with the streamers were adopted in this study to understand the practical issues in live-streaming industry. This study proposes that due to different industrial characteristics, it needs to clarify the applicable laws for regulating live streaming and establish self-regulation for platforms and streamers to achieve the balance between legislation and self-regulation. Therefore, the live-streaming industry will move towards a more stable and positive development.
